Privacy Charter - Rules for the processing of personal data

This Privacy Policy applies to any activity, commercial operation or service carried out by Pixelleo, operating under the trade name "Pixelleo", this Policy being available on the website https://www.pixelleo.com (hereinafter, "the site", and subject to other contractual documents that would govern certain services provided by Pixelleo).




This Privacy Charter belongs to Pixelleo, having its registered office at charbonnage 11, 4460 Grâce-hollogne, registered with the BCE under n° BE0745971471 (hereinafter referred to as "Pixelleo", the "Service Provider", the "Data Controller" or "We"). 




We make it a point of honour to respect the privacy of our clients and service providers and to process their personal data in the strictest confidentiality and in accordance with the legislation in force.




The Privacy Policy is intended to inform you, in full transparency, about the data we collect, the purpose of their collection, the way we use them and the rights you have regarding the processing of your personal data.




This Privacy Policy of Pixelleo (hereinafter the "Privacy Policy") applies to relations between Pixelleo and third parties.




The purpose of this Charter is to secure the data of individuals on the basis of a relationship of trust with our customers.



The management of your personal data implies compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

Pixelleo collects personal information only if it is provided on a voluntary basis (consent), or is justified due to contractual or pre-contractual measures, as well as due to a legal obligation incumbent upon it.




By reading this Charter and by communicating your consent or by entering into a contract with Pixelleo, you acknowledge that you have read and accepted the conditions set out in this Charter as well as the purposes and methods of processing it implies.

3. Legal basis of the processing operation




Data may be collected on the basis of the consent of the person concerned, which is specifically reported, free and informed by means of a written declaration.




We can request your consent in writing or electronically. When you give your consent, we will inform you of how your data will be used and the specific purposes. Once you have given your consent, you may withdraw it at any time.




In a pre-contractual phase, data may also be collected on the basis that it is necessary for the execution of such pre-contractual measures taken at the request of the person concerned.




When Pixelleo concludes a contract with the data subject, the processing of the personal data collected is necessary for the execution of the contract concluded between the parties. 




After the execution of the contract, the person concerned consents to the personal data transmitted in the pre-contractual and contractual phases continuing to be processed by Pixelleo insofar as the processing is made necessary by a conflict between Pixelleo and the person concerned or because of any legal obligation imposed on him/her. 




In some cases, we may need to process your personal data because the applicable laws in force require or authorize, for example, to prevent, detect and investigate fraud or crimes.




In many cases, we process your personal data because we have a legitimate business interest in doing so. This is the case, for example, when we process your personal data to communicate with you, defend your interests, improve the quality of our products and/or services, and manage our business and IT operations. By entering into a business relationship with Pixelleo and by using the website, you consent to the collection and processing of the following personal data:




contact information (such as name, position, address, email and telephone numbers);




Personal characteristics (such as gender, date and place of birth);




Government and other identification numbers, subject to applicable laws and regulations;




Financial information and details of the bank account(s) provided;




Voicemail recordings;




Photographs submitted for the purpose of document filing;




Information enabling us to provide our products and/or services;




Marketing preferences, marketing activities and customer feedback;




 Information about online activities (such as information from your use of the Pixelleo website); 




additional sources, from publicly available information sources;




Postal address, e-mail address, telephone number and any similar information, necessary or useful for the execution of the contract and the follow-up of the requests addressed to us;

The pages possibly consulted during a certain period of time;

The platform and/or operating system installed on your computer;




The search engine and the keywords used to find the service's site.




The downloaded files ;




The choice of language;




In general, any information given voluntarily when using the services of Pixelleo or any request made on the Site.



This data is collected in particular for the following purposes:




In order to communicate with you;




To ensure the defence of your interests in or out of court;




To establish, execute and terminate contracts relating to our services;




To evaluate and decide on the terms and conditions of these contracts;




Provide products and/or services that we offer;




To improve the quality of our products and/or services;




Manage our business operations and IT infrastructure;




Manage complaints, comments and queries;




Comply with applicable laws and regulatory obligations;




Establish and/or defend our legal rights.




To allow this data to be used within the framework of the contractual relationship concluded between Pixelleo and the person concerned ;




To allow your access to the services offered on the Pixelleo website and allowing you to order products and services and to download applications; 




Register your requests and follow up on them (contact form, product order form, downloading of applications);




Send you information, including by e-mail, about products and services that Pixelleo provides;




To carry out statistics or market research.



We also keep all optional information voluntarily given by the user for the purpose of improving the Site. The history of requests and written communications is also kept to facilitate the management of the relationship with the user.


8. Rights of individuals



In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, you have the right to access and modify your personal data. You may send your requests for consultation, modification or opposition by contacting us at the contact details mentioned in article 2 hereof (by sending us a copy of your identity card). 




You must have the right to obtain confirmation as to whether or not your personal data is being processed and, if so, to have access to your personal data and information concerning the processing.




You may request the rectification of erroneous, inaccurate or incomplete data.




You have the right to object to the processing of your personal data on certain grounds and the right at any time to object to the use of your personal data.




If you have consented to our processing of your personal data, you have the right to withdraw your consent at any time, without such withdrawal affecting the lawfulness of the processing on the basis of the consent prior to its withdrawal.




Subject to certain conditions, you have the right to (i) have your personal data deleted. In the event that your personal data has been made public, Pixelleo will take reasonable steps to inform the data controllers of your request to delete your personal data and to inform the recipients of the personal data of your request to delete your personal data; (ii) you have the right to obtain a restriction on the processing of your personal data and, in case of restriction, to limit the processing to mere storage; and (iii) you have the right to receive your personal data, which you may re-use as you wish. If you so request, Boucherie Stevens is obliged to transfer your personal data directly to another data controller.




You also have the right to request the limitation of the processing of your data, as well as the right to the portability of your data.




In addition, any e-mails or newsletters that you may receive will contain a link that you can click on so that you no longer receive promotional information from us. 



9. Responsibilities of the user



Although Pixelleo makes every effort to protect your privacy, effective protection is naturally only possible if you also take the necessary measures to safeguard your privacy yourself.




As the person concerned, you are obliged to :




- provide complete, accurate, truthful and untruthful information ;




- duly ensure the confidentiality of any user data (such as a user name, password, token or PIN code), so that this data remains accessible only to you. These data are strictly personal and non-transferable;




- transmit valid and usable contact information so that you can be contacted within a reasonable period of time and in a reasonably confidential manner.


10. Data sharing and transfer



In the context of the purposes described above in article 4, we may share your personal data with third parties, called "recipients".



These third parties (Recipients) may include :



Third party external service providers (e.g. auditors, experts, lawyers and other professional advisors; travel and medical assistance service providers; computer systems, accommodation service providers, banks and financial institutions, third party claims administrators and other third party service providers) us in the performance of our business activities);




Government authorities ;




Third parties involved in legal proceedings and their advisers; and




Other third parties (bailiffs, notaries, registries, administrations, etc.).



Pixelleo may receive or transfer the personal data of the persons concerned to countries outside the European Union.



Due to the global nature of our business, we may transfer your personal data to entities (recipients) located in non-EEA countries that do not offer adequate protection of personal data.



If personal data is transferred from the EEA to a country outside the EEA that does not provide adequate protection for personal data, we will ensure that appropriate safeguards are in place to protect your personal data against standards equivalent to the standards contained in this document. In other words, Pixelleowill remain responsible for the processing of your personal data and will take the necessary measures to protect the processing.



For any possible transfer to a third country, Pixelleo guarantees that this transfer is carried out in a lawful manner and in accordance with the principles set out in articles 44 and following of the European Data Protection Regulation.



11. Modification of the Charter



This Charter may be amended at any time by Pixelleo according to changes made to the Site and the services accessible through it, changes in legislation or for any other legitimate reason. 




These changes come into force immediately after they are put online. If necessary, an email will be sent to you to inform you of these modifications.
